You may require a permit, depending on your situation.

  • 30-inch rule: New decks over 30 inches above grade require a permit under the Rhode Island State Building Code.
  • Attached decks: Any deck attached to a dwelling must have a permit, regardless of height.
  • Other triggers: Decks larger than 200 sq ft, decks with electrical components, or structural modifications usually require permits.
  • Exemptions: Ground-level decks under 30 inches high and freestanding temporary structures are generally exempt.

Additional requirements for decks over 30 inches:

  • Frost line: Footings must be at least 42 inches below undisturbed soil.
  • Railing height: Minimum 36 inches from deck surface to top rail; 42 inches recommended for decks over 30 inches.
  • Baluster spacing: No more than 4 inches between balusters.

Decks need occasional cleaning, sealing, and inspections to stay safe, beautiful, and long-lasting. We recommend:

  • Wash annually with deck-safe cleaner.
  • Check for rot, loose screws, or pooling water.
  • Reseal or stain every few years depending on material and exposure.
  • Inspect railings and balusters regularly for safety.
